Maternity leave date


Your expected week of childbirth (EWC) is DD Month Year. This is the week, starting on a Sunday, in which the doctor or midwife expects you to give birth.

Based on your baby’s due date your intended maternity leave date must start between DD Month Year and DD Month Year.

To qualify for Occupational Maternity Pay, you must have completed 12 months' continuous service with one or more NHS employer at the beginning of the 11th week before the expected week of childbirth. To have worked long enough to get Statutory Maternity Pay (SMP), you need to have been employed by the same employer continuously for 26 weeks by the end of the qualifying week (DD Month YYYY).

Maternity leave entitlement


The pregnant employee can take up to 52 weeks of maternity leave. The leave will end if they go back to work. In addition to a period of paid leave, eligible employees are also entitled to take a further 13 weeks of unpaid leave to take their total maternity leave period to 52 weeks.

To guarantee payments you must notify your manager by completing the maternity leave form. This must be completed before the end of the 15th week before your expected week of childbirth. Based on your due date this would be the week starting [DD Month year].

Statutory Maternity Pay entitlement


When on maternity leave, employees cannot be paid more than they would have received had they been at work. If you are eligible for Occupational Maternity Pay, the first 8 weeks of maternity leave will be paid at your full pay rate. This means that the first 8 weeks of Statutory Maternity Pay entitlements will be paid and recovered, so you do not receive more than your full pay.
